“GIFT VOUCHER” PROMOTION PARQUE INGENIEROS
T&C 1. – DESCRIPTION AND PURPOSE OF THE PROMOTION
This commercial promotion (the “Promotion”) consisting of the delivery of a gift voucher worth one thousand euros (€1,000) from El Corte Inglés (“ECI”) shall be governed by these terms and conditions for the duration of the Promotion.
This Promotion shall be applicable to the rental of properties, understood as the houses and their annexes located at plot M9 of the APE 17.02 “Parque Central de Ingenieros de Villaverde” of the General Urban Development Plan of Madrid (hereinafter the “Properties”), owned by PLAINFIELD SPAIN, S.L. (hereinafter the “Property” or “PLAINFIELD“) and which are being commercialised by AQ ACENTOR DEVELOPMENT, S.L. and published on its website aq-acentor.com.
The Promotion is applicable exclusively to the renting of houses together with those annexes that are jointly rented. The Promotion will therefore not be applicable to the rental of independent and/or non-housing storage rooms or parking spaces. This Promotion does not apply to commercial premises.
T&C 2. – PERIOD OF VALIDITY
The Promotion will apply to all those operations in which a housing (and, where applicable, annex) rental contract has been formalized, (hereinafter the “Contract”) during the period from 03/07/2020 to 30/08/2020 (both inclusive), and provided that the corresponding Contract is signed within this period.
T&C 3. – ACCEPTANCE OF THE PROMOTION
Natural persons of legal age or legal entities that participate in the Promotion (hereinafter, “Participants”) accept these Terms and Conditions in full.
On the signing of the rental contract, the gift will be given to you on presentation of your ID card and with the signature of the corresponding acknowledgement of receipt.
T&C 4. – NON-CUMULATIVE NATURE OF THE PROMOTION
The Promotion cannot be used in conjunction with any other offers or promotions that exist at the time of its starting date, or any other that may occur throughout its period of validity, unless expressly identified as being cumulative with this Promotion.
For each of the Properties (i.e. each house with its annexes), and the effective signing of the corresponding rental contract, this will only afford the right to receive a voucher for the value of €1,000 from ECI.
T&C 5. – MODIFICATION AND SUSPENSION OF THE PROMOTION
AQ ACENTOR, without prejudice to the commitments already made, reserves the right, at any time and at its sole discretion, to terminate, suspend, delay or modify the Promotion in any of its terms and conditions, including by suspending or altering the timing of the same.
For clarification purposes, it should be noted that AQ ACENTOR may modify, suspend, delay or terminate this Promotion without the need to individually communicate this to its customers, and it is sufficient for this purpose for it to publish this on its website or through any other means of communication that it deems appropriate.
To be eligible for the prize, the customer must:
(i) have the express offer of AQ ACENTOR to be able to rent a property and participate in this Promotion.
(ii) be over eighteen years of age;
(iii) have contracted and entered into a lease with PLAINFIELD during the promotional period;
(iv) comply with the conditions stipulated in these T&Cs without any manipulation, in any form, fraudulent or artificial, in their participation.
(v) comply fully with the terms of the rental agreement, agreeing to return the equivalent amount of the Promotion to PLAINFIELD if the lease is settled for reasons attributable to the Participant or lessee.
(vi) keep the lease in place for a minimum period of twelve (12) months from signing, being obliged to return to PLAINFIELD an amount equivalent to the gift voucher received, in the event of termination of the contract before that date without just cause.
T&C 6. – NO LIABILITY
AQ ACENTOR shall not be responsible for the following:
Modification or suspension of the Promotion or acceptance of offers under different conditions: by participating in this Promotion the Participant is aware of and accepts the Terms and Conditions, including the powers of AQ ACENTOR to modify them or suspend the Promotion unilaterally, as well as to accept offers under different conditions, renouncing to claim responsibility, compensation, damages or indemnification of any kind from AQ ACENTOR for the possible modification of the Terms and Conditions, suspension of the Promotion, non-acceptance of offers or acceptance of them under conditions different from those outlined in these Terms and Conditions.
Any errors, defects or omissions: in the information provided in these Terms and Conditions derived from sources outside the Property and that, where appropriate, could cause damage or injury to the Participant.
T&C 7. – TAXATION
The gift voucher will be subject to Personal Income Tax (“IRPF”) as capital gain not derived from a transfer of assets. As such, it will be included in the recipient’s general taxable base and will be subject to the relevant general tax assessment scale.
T&C 8. – DATA PROTECTION
The Participant is informed that the personal data requested and provided as a result of this Promotion will be processed and managed by organisation responsible, AQ ACENTOR DEVELOPMENT, S.L. with registered office at Paseo de la Castellana 259-D, Edificio Torre Europa Planta 14. 28046 Madrid, in order to manage their participation in this Promotion as well as any other actions resulting from it, in the manner and within the limitations and rights granted by the applicable legislation.
The Participant may exercise their rights of access, rectification, deletion, limitation of processing and transfer and opposition, where applicable, by letter accompanied by a copy of their ID addressed to:

Participation in the Promotion will entail the necessary communication of Customer data to El Corte Inglés, for the exclusive purpose of enabling the presentation of the Prizes. In the event that Participants do not consent to the communication of their data to El Corte Inglés for the aforementioned purposes, they must communicate this using the form indicated on the aforementioned website. In the event of such communication, it will result in the exclusion of the Participant(s) from the Promotion.
T&C 9. – NON-CONSIDERATION OF OFFER
This Promotion does not in itself imply any proposal or obligation to the customers for the rental of the Properties.
The acceptance of each offer will be carried out by AQ ACENTOR on an individual basis, in accordance with the applicable internal criteria for the acceptance of offers of this entity. However, once accepted by the Property and the contracts have been formalised as indicated in these Terms and Conditions, the contents of this document shall apply to them.
T&C 10. – IMAGE RIGHTS
Participation in the promotion implies full acceptance of these terms and conditions by the Participants and, with respect to the
winning customers, if they accept and receive the prize, it also means their full
authorisation for PLAINFIELD to process the data relating to their identity and image without the right to any consideration, for advertising and/or promotional purposes of the entity related to the PROMOTION €1,000 GIFT VOUCHER. The subsequent revocation of this authorization within a period of less than one (1) year from such acceptance will result in the renunciation of the prize by the winning customer or the return of the amount of its value to PLAINFIELD, if it has already been received.
T&C 11. – INTERPRETATION OF THE TERMS AND CONDITIONS AND APPLICABLE LAW
These Terms and Conditions are subject to Spanish common law and any contingency arising from the interpretation or application thereof shall be subject to the decision of the Courts of the city of Madrid. The above is without prejudice to the compulsory jurisdictions according to the procedural legislation in force.
T&C 12. – STORAGE OF THE TERMS AND CONDITIONS
The Terms and Conditions of this Promotion are stored and registered with the notary’s office of D. Jorge Sáez-Santurtún Prieto at Calle Claudio Coello, 91, 2º, 28006, Madrid, and will be available to any person who wishes to consult them.
